BUYERS TERMS
1) Although every effort is made by The The Spanish Property Guide
to verify information given in their brochures and promotional
material, it must be clearly understood that such information
does not form part of any contract or offer. Any intending purchaser
or tenant of a property or a business must satisfy themselves
as to the correctness of any information either printed or verbally
issued by The Spanishpropertyguide, it's agents, associates or
employees.
2)The Spanish Property Guide make every effort to keep up to
date the information stated in its' brochures and other promotional
material, but it cannot guarantee that particular properties and
businesses will still be available for sale when prospective purchasers
travel to Spain to view. Vendors may increase or decrease the
price of properties/ businesses and no guarantee is given that
the price shown in The Spanishpropertyguide brochure will remain
accurate.
3) The Spanish Property Guide does not accept any liability to
interested purchasers or tenants resulting from their inability
to view properties and businesses in which they may be interested
due to the fact that the properties or businesses may no longer
be available for sale, or to let, or due to revision of purchase
prices, or due to unforeseen circumstances.
4) With regard to businesses in Spain. All turnover and profit
estimates given in the Spanish Property Guide brochure are 'word
of mouth' from the vendors. It remains the responsibility of the
purchaser to verify the accuracy of these figures. The Spanish
Property Guide makes no guarantees with regard to the profits
which can be earned from such businesses, nor with regard to the
date on which such businesses may commence to earn profits and
it cannot be responsible for any delays or failure of a business
to produce expected profits.
5) The Spanish Property Guide operates as an introducing agent
to assist interested persons in finding and purchasing properties
and businesses in Spain. Spanish Property Guide is not liable
for any loss which they may incur for any reason whatsoever resulting
from their interest in purchasing, attempted purchase or actual
purchase of a property or a business in Spain.
6) Land, property and room sizes given in The Spanish Property
Guide brochures are subject to survey. It remains the responsibility
of the purchasers to satisfy themselves as to the correctness
of such information.
7) All contracts for transport by rail, sea, air or on land,
for accommodation, board and lodging, for legal and estate agency
services, or for any other associated services shall be deemed
to be contracts between the person/s travelling and the service
provider. The Spanishpropertyguide shall not be liable for any
claims, loss, liabilities or judgements arising out of such contracts.
8) The Spanish Property Guide makes every endeavour to recommend
only reliable and reputable providers of transport, accommodation,
legal, estate agency and other services and shall not be held
responsible or liable for any loss or damage resulting from such
recommendations.
9) The Spanish Property Guide shall not be held liable or responsible
for the actions of other persons or companies or firms operating
in Spain with which it may be associated or have connections.
10) Countryside building plots - The local authority in Spain
require minimum plot sizes before allowing construction. This
varies from area to area. Building plots described in The Spanishpropertyguide
brochures and literature comply with the minimum plot size requirements
at the time of going to press. These requirements are subject
to change and it remains the responsibility of purchasers of plots
of land to acquire all necessary planning consents and licences.
11) Any disputes regarding contracts entered into in Spain shall
be resolved according to Spanish law.
12) Accommodation. Where this is arranged by our associates in
Spain it will always be at their discretion and this must be paid
on arrival in Spain, by either traveller's cheques or cash. Cheques
drawn on UK banks are not accepted in Spain.
13) Insurance. When visiting Spain it is advisable to arrange
suitable comprehensive insurance cover. Spanishpropertyguide accept
no liability whatsoever for losses, damages, compensation or personal
injury resulting from a viewing trip to Spain.
13) Clients are advised that whilst every attempt is made to
hold a property on a 'refundable deposit', depending on the length
of time purchasers take to view, we cannot guarantee any individual
property or price. However, any client who does not want to proceed
will have their deposits refunded in full.
14) A non-refundable deposit - this payment will be transfered
from The Spanish Property Guide clients account direct to the
builder or developer's account, once this has happened there is
no refund of monies. Refunds are at the discretion of the Companies
M.D.
